This Agreement takes effect on the date an order is placed, between Testa-Seat, Inc. (“Provider”) and the Individual or Organization placing the order (“Recipient”).

Purpose

This Agreement outlines the terms under which Testa-Seat, Inc. provides a 30-Day Trial Kit for evaluation and demonstration.

Terms

1. Trial Period

• The Trial Kit is supplied at no cost for 30 days starting from delivery.

• At the end of the trial, the Recipient agrees to return the Kit in its original packaging and condition (normal wear and tear excepted).

• Extensions may be requested and approved by Testa-Seat, Inc.

2. Warranty During Trial

• If a seat breaks under normal use, Testa-Seat, Inc. will repair or replace it at its discretion.

• This warranty excludes damage from misuse, neglect, or unauthorized changes.

3. After the Trial

• If the Kit is not returned within 30 days after the trial ends, the Recipient may be invoiced for its retail value.

• Testa-Seat, Inc. covers the cost of return shipping.

• If the Recipient chooses to place an order, Testa-Seat, Inc. may allow the Trial Kit to be kept at no additional cost.

4. Proper Use

The Trial Kit is provided for evaluation and demonstration only.
The Recipient agrees to:

• Use the Kit responsibly for these purposes.

• Follow the User Guide provided online.

5. Care & Maintenance

The Recipient agrees to:

• Keep the Kit in good condition and protect it from damage.

• Notify Testa-Seat, Inc. promptly if damage or malfunction occurs.

6. Liability

• The Trial Kit is used at the Recipient’s own risk.

• Testa-Seat, Inc. is not liable for any injury, damage, or loss arising from its use.

• The Recipient agrees to indemnify Testa-Seat, Inc. against claims arising from misuse of the Trial Kit.

7. Use Outside Demonstration Settings

If the Kit is shared outside the Recipient’s immediate setting (e.g. loaned to families):

• The Recipient must explain basic use (setup, care, and adjustments).

• Users should review the User Guide before use.

• The Recipient should connect users with Testa-Seat, Inc. if questions arise.

• Testa-Seat, Inc. is not liable for damages or injuries from such use.

• Failure to follow instructions may void warranty coverage.

8. Termination

Either party may terminate this Agreement with 15 days’ written notice.
Upon termination, the Recipient must return the Trial Kit immediately.

Entire Agreement

This document is the full agreement between the Provider and Recipient and replaces any prior discussions or arrangements.

Acknowledgment

• The Agreement begins on the date of order placement.

• The 30-Day Trial starts on the date of delivery.

Trial Kit Availability
The shipment of the Trial Kit is subject to the availability of an appropriate demo kit. Testa-Seat, Inc. will place the Recipient on a waiting list and notify them when a demo kit becomes available. Shipment arrangements will be made at that time, and the trial period will commence upon delivery of the kit, as outlined in the "Trial Period" section.

No Guaranteed Shipment Date
While Testa-Seat, Inc. will make reasonable efforts to provide the Trial Kit in a timely manner, no specific shipment date is guaranteed. Availability is determined at the sole discretion of Testa-Seat, Inc., and orders will be fulfilled in the order they were received.
